GX1 Football Technology — Terms of Use
These Terms of Use ("Terms") govern access to and use of the GX1 Football Technology platform ("GX1", "we", "us", "the Platform"). By creating an account, accepting an invitation to GX1, or otherwise using the Platform, you agree to these Terms.
1. About GX1
GX1 is academy management software for football (soccer) academies ("Academies"). An Academy uses GX1 to manage its own athletes, coaches, calendar, attendance, development assessments, and communication with parents/guardians. GX1 provides and operates the technology; each Academy is responsible for how it runs its own football operations on it.
2. Acceptance of Terms
You accept these Terms by ticking the acceptance checkbox presented when you create your account, accept an invitation to GX1, or (for an account created before these Terms existed) when you are prompted to review and accept them on your next sign-in. If you do not agree, do not create an account or continue using GX1. Where a person is acting on behalf of an Academy, they confirm they are authorised to accept these Terms for that Academy's use of GX1.
3. Purpose of GX1
GX1 exists to help football academies run their day-to-day operations more effectively: organising sessions and calendars, recording attendance, tracking player development, and keeping families informed. GX1 is a software tool. It does not run training sessions, select teams, or make coaching or football decisions of any kind.
4. Eligibility
GX1 accounts are for Academy Admins, Coaches, and Parents/ Guardians acting on behalf of an Academy that has chosen to use GX1, plus platform-level Super Admin accounts operated by GX1 itself. Young players do not hold their own GX1 account; their information is managed by their Academy and their linked parent/guardian account. You must be at least 18 years old, or otherwise have the legal capacity required in your jurisdiction, to hold an Academy Admin, Coach, or Parent/Guardian account.
5. User Accounts
You cannot sign up for a GX1 login on your own. Every login account is created by invitation: an Academy Admin adds you as a Coach or Parent/Guardian, or a GX1 Super Admin sets up a new Academy Admin. You choose your own password when you accept an invitation, and confirm these Terms and the Privacy Policy at that time (or, for an account created before this requirement existed, on your next sign-in). Separately, GX1 also offers a public player-registration form that some Academies use to collect enrolment information directly from a parent/guardian; completing that form does not, by itself, create a GX1 login.
6. Account Security
You are responsible for keeping your password confidential and for all activity that occurs under your account. Tell your Academy Admin, or GX1 using the contact details in section 44, immediately if you believe your account has been accessed without your permission. GX1 supports optional two-factor authentication for Academy Admin and Super Admin accounts, which we recommend enabling.
7. Academy Administrators
An Academy Admin manages their Academy's own use of GX1: inviting and removing Coach and Parent/Guardian logins, entering or approving athlete and program information, configuring the Academy's branding and settings, and deciding who within the Academy can see what. The Academy Admin is responsible for having appropriate authority to act for the Academy, and for the accuracy and lawfulness of the information the Academy enters into GX1.
8. Coaches
A Coach account lets its holder manage sessions, record attendance, and complete assessments and development reports for the athletes their Academy assigns to them. A Coach acts under the direction and supervision of their Academy; GX1 is not the Coach's employer and has no role in coaching decisions, employment terms, or player selection.
9. Parents and Guardians
A Parent/Guardian account lets its holder follow their own child's training, attendance, and published development information, message their Academy, and receive notifications. By using a Parent/Guardian account you confirm you are the parent, legal guardian, or otherwise properly authorised to access and manage information relating to the child/children linked to that account. An Academy Admin is responsible for linking a Parent/Guardian account to the correct athlete(s).
10. Children and Young Players
Much of what GX1 stores concerns athletes, many of whom are children. Children do not hold their own GX1 login. Their Academy is responsible for having the appropriate authority, lawful basis, and any consents required before entering a child's information into GX1, and a Parent/Guardian should only manage a child's information where they are properly authorised to do so. GX1 provides the technology that stores and displays this information as instructed by the Academy; GX1 is not a childcare provider and does not supervise, and is not responsible for the supervision of, any child.
11. Academy Responsibilities
The Academy using GX1 remains responsible for:
- its coaches and staff, and their conduct;
- the physical running of its sessions, training, and matches;
- supervision, safeguarding, and welfare of its players;
- its facilities and equipment;
- all sporting and coaching decisions, including team and player selection;
- the accuracy and lawfulness of information it enters into GX1;
- the content of communications it sends through GX1; and
- obtaining any permissions or authority it needs concerning the players and families it enters into GX1.
12. GX1's Role
GX1 provides software and technology. Unless separately agreed in writing, GX1:
- does not operate the Academy;
- is not the employer of, and does not supervise, an Academy's coaches or staff;
- is not responsible for coaching decisions or player selection;
- is not a childcare provider;
- is not a medical provider or physiotherapist;
- is not a player agent;
- does not guarantee professional opportunities, scholarships, trials, or any other sporting outcome; and
- does not guarantee any particular player development outcome.
These Terms do not limit or exclude any right or remedy that cannot lawfully be excluded - see section 37.
13. Football Development Information
Coaches can record skill assessments and development reports reflecting their own professional judgment. GX1 provides the tool to record and share this information; it does not evaluate any athlete itself, does not set assessment criteria (each Academy configures its own), and makes no claim as to the accuracy of any individual assessment.
14. Statistics and Reports
Attendance records, match statistics, and exported reports (for example, PDF development reports) reflect data entered by an Academy's own staff. GX1 compiles and presents this data as entered; it does not independently verify it and is not responsible for decisions made in reliance on it.
15. No Guarantee of Sporting Outcomes
Nothing on GX1 - including development reports, statistics, or any feature of the Platform - is a promise or guarantee of any sporting outcome, including trials, selection, scholarships, college or professional pathways, or any other opportunity. Sporting outcomes depend on many factors outside GX1's control.
16. Health and Injury Information
Where an Academy chooses to record an athlete's medical information (allergies, injuries, medications, disabilities) for safeguarding and emergency purposes, that information is only as accurate and current as what the Academy or parent/guardian entered. GX1 is not a medical record system, does not provide medical advice, and must not be relied on as the sole source of emergency medical or health information - an Academy should maintain its own appropriate emergency procedures independent of GX1's availability.
17. Attendance and Sessions
Calendar events, session details, and attendance records are created and maintained by an Academy's own staff. GX1 does not schedule, run, or supervise any session, and is not responsible for the physical conduct of any training, match, or other in-person activity.
18. Messaging and Communications
GX1's messaging feature is for communication between an Academy's staff and its families. Use it respectfully and only for its intended purpose. Message content is visible to its participants and, where relevant, to the Academy operating the account. GX1 must not be relied upon as the sole or primary emergency communication system between an Academy and a family.
19. Push Notifications
If you enable push notifications on the GX1 Android/iOS app, GX1 uses a third-party push notification service (see section 26) to deliver alerts about messages, announcements, and session updates to your device. You can disable push notifications at any time in your device settings; doing so does not affect your ability to use GX1 through the app or a web browser.
20. User Content
Academies and their staff enter and upload information into GX1 - athlete details, documents, messages, assessments, and similar records ("User Content"). You, or your Academy, remain responsible for the accuracy of User Content and for having the right to submit it. GX1 stores and displays User Content as instructed by the Academy that entered it; GX1 does not create, edit, or independently verify User Content.
21. Photos, Videos and Media
Academies can upload photos (for example, an athlete or coach profile photo) and, through the registration flow, request supporting documents. Do not upload anything you do not have the right to share, or anything unrelated to the athlete or registration it is attached to. An Academy is responsible for obtaining any consent it needs (for example, media/publicity consent from a parent/guardian) before it uses a photo or video in a particular way.
22. Acceptable Use
You agree not to:
- access or attempt to access another Academy's data, or another user's account;
- upload unlawful content, or content you do not have the right to share;
- attempt to disrupt, probe, reverse-engineer, or bypass the security of the Platform;
- use the messaging or notification features to harass, spam, or contact someone outside their intended purpose; or
- use GX1 for any purpose other than legitimate football academy management.
23. Intellectual Property
Except for User Content and third-party content, GX1 Football Technology retains all right, title, and interest in the GX1 platform, including its software, source code, system architecture, database structures, interfaces, design system, functionality, documentation, and the GX1 name and branding. Using GX1 gives you a licence to use the service as provided, for its intended purpose, for as long as your account is active. Nothing in these Terms transfers ownership of GX1's software or technology to you or your Academy.
24. Academy Content and Branding
Each Academy retains ownership of its own name, logo, and branding materials. By configuring its GX1 account with this material, an Academy grants GX1 a limited licence to display it within the Platform (and, where applicable, within a white-label app - see section 25) solely to provide the service to that Academy. This does not give GX1 any independent rights to use an Academy's branding outside of operating GX1 for that Academy.
25. White-label / Academy-branded Applications
GX1 may provide certain Academies with a white-label, Academy- branded version of the app (its own name, logo, and colours applied to the GX1 shell). In that arrangement:
- the Academy owns its own name, logo, and trademarks;
- the Academy grants GX1 the limited permission necessary to use that branding to build and provide the branded app;
- GX1 owns and retains all right, title, and interest in the underlying GX1 technology, including its source code, system architecture, database structures, and underlying design and functionality;
- creating a branded app for an Academy does not transfer any ownership of GX1's technology to that Academy; and
- the Academy receives a licence to access and use the service, not a transfer of source-code ownership, unless a separate written agreement expressly says otherwise.
26. Third-party Services
GX1 relies on a small number of third-party providers to operate the Platform (for example, hosting/database infrastructure, email delivery, and push notification delivery) - see the Privacy Policy for the current list. An Academy Admin can also add their own external "Term Links" inside GX1 (for example, a payment page or a form for the next season/term); these open outside GX1, in your device's own browser. GX1 is not responsible for the content, terms, or privacy practices of any third-party site or service it does not operate.
27. Platform Availability
We aim to keep GX1 available and working correctly, but - to the maximum extent permitted by law - do not guarantee uninterrupted or error-free access. The Platform may occasionally be unavailable for reasons within or outside our control.
28. Maintenance
GX1 may need to carry out scheduled or emergency maintenance that temporarily affects availability. Where practical, we aim to schedule planned maintenance at low-usage times and to keep any disruption brief.
29. Security
We take reasonable technical and organisational steps to protect GX1 and the information on it, including encrypted transport, hashed passwords, and role-based, per-Academy access controls described further in the Privacy Policy. No system can be guaranteed completely secure, and we do not represent that GX1 is immune from unauthorised access, loss, or misuse.
30. Backups / Important Records
While GX1 takes reasonable steps to protect against data loss, you should not treat GX1 as your Academy's sole record for information that must legally or operationally be retained elsewhere (for example, original signed waivers, medical action plans, or safeguarding records an Academy is independently required to keep).
31. Privacy
Our Privacy Policy explains what personal information GX1 handles and why, and is incorporated into these Terms by reference. If anything in these Terms conflicts with the Privacy Policy on how information is handled, the Privacy Policy governs.
32. Suspension
An Academy Admin can deactivate a Coach's or Parent/Guardian's login within their own Academy at any time. GX1 may suspend access to the Platform - for an individual account or an entire Academy - where we reasonably believe these Terms have been violated, or as reasonably necessary to protect the Platform, its users, or GX1.
33. Termination
You may stop using GX1 at any time. GX1 may terminate an account or an Academy's access for a material or repeated breach of these Terms, where reasonably necessary to protect the Platform or other users, or where an Academy's own agreement with GX1 (if any) ends. Where practical, we will give reasonable notice before terminating an active Academy's access.
34. Account Deletion
You can request deletion of your own GX1 account at any time. See our Account & Data Deletion page for exactly what that does and does not remove - for example, deleting a Parent/Guardian's login does not delete their child's athlete record, which the Academy continues to maintain.
35. Data Following Termination
If your account or your Academy's access is terminated, GX1 retains data only for as long as reasonably necessary - to allow an orderly wind-down, to meet any legal retention obligation, or as otherwise described in the Privacy Policy - before it is deleted or de-identified.
36. Pilot and Testing Availability
GX1 is currently being provided on a limited pilot and testing basis, for the purpose of evaluating, developing, and improving the Platform with a limited number of participating Academies. Access may currently be provided without charge to participating Academies and users. This does not mean that GX1 is operated on a non-profit, not-for-profit, or charitable basis - GX1 is not any of these, and the absence of a current fee reflects the pilot stage of the Platform, not its underlying nature.
During the pilot, features, functionality, availability, and workflows may change as the Platform is tested and improved, new features may be added or removed, temporary interruptions may occur, and feedback from participating Academies and users may be used to improve GX1. Software at this stage may contain bugs; to the maximum extent permitted by law, and subject to section 37, GX1 is not liable for loss arising from the experimental or evolving nature of a pilot deployment.
Participation in the current pilot does not guarantee that the Platform, any particular feature, or free access will continue indefinitely, and does not itself create a promise of permanent free access, future commercial access, fixed pricing, or guaranteed continued availability - nor does it transfer any ownership of GX1's technology or source code (see sections 23 and 25). GX1 may in the future introduce commercial subscriptions, licensing arrangements, white-label fees, or other charges. Any applicable commercial terms or fees, and any future commercial relationship with an Academy, will be the subject of a separate written agreement (for example a SaaS, licence, white-label, or other commercial agreement) and will be communicated and agreed with the relevant Academy or user before they apply. No such agreement is created by these Terms.
37. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. Where GX1's services are not of a kind ordinarily acquired for personal, domestic, or household use, GX1's liability for a failure to comply with a consumer guarantee is, to the maximum extent permitted by law, limited to the resupply of the services or the cost of having the services supplied again. To the extent this section conflicts with any other section of these Terms, this section prevails.
38. Limitation of Liability
To the maximum extent permitted by law, and subject to section 37, GX1's total liability arising out of or in connection with these Terms or your use of the Platform - whether in contract, tort (including negligence), or otherwise - is limited to the amount you or your Academy actually paid GX1 for the Platform in the twelve (12) months before the event giving rise to the claim, or, where no fee has been paid, is limited as far as the law allows. GX1 is not liable for indirect, consequential, or special loss, or for any sporting, developmental, or financial outcome referred to in sections 12-16.
39. Academy/User Responsibility
Each Academy and user is responsible for information they enter into GX1, decisions they make using GX1, and their own compliance with laws that apply to their own conduct (including child safety, employment, and privacy obligations that apply to the Academy independently of GX1). GX1 provides the tenant isolation that keeps one Academy's data separate from another's, but does not control what an Academy chooses to enter or who an Academy Admin invites into their own Academy.
40. Reasonable Indemnity
To the extent permitted by law, you (or your Academy) agree to indemnify GX1 against reasonable losses, costs, or claims GX1 directly suffers as a result of your breach of these Terms, your unlawful use of the Platform, or content you submit that infringes a third party's rights - except to the extent caused by GX1's own negligence, wilful misconduct, or breach of these Terms. This indemnity is not intended to, and does not, exclude or limit any right or protection you have under the Australian Consumer Law.
41. Changes to GX1
GX1's features may change over time as the Platform is developed further. We will not remove a feature an Academy materially relies on without reasonable notice where practicable.
42. Changes to Terms
We may update these Terms as GX1's functionality or legal requirements change. Where a change is material, we will ask you to review and accept the updated Terms before you can continue using GX1, in the same way described in section 2. The version number and effective date at the top of this page reflect the current version.
43. Governing Law
These Terms are governed by the laws of Australia. Each party submits to the non-exclusive jurisdiction of the courts of Australia in relation to any dispute arising out of or in connection with these Terms.
44. Complaints and Contact
If you have a complaint or question about these Terms, contact us at gx1sportstechnologies@gmail.com. We aim to acknowledge complaints promptly and work with you (and your Academy, where relevant) to resolve them.
These Terms describe GX1 Football Technology as it actually operates today - no feature, guarantee, or payment obligation is described here that the Platform does not actually have.
